So, now, after the appeals court rejected the company's request for more time, TikTok, must act quickly to look for the Supreme Court intervention in order to block or even overturn the law that requires the ByteDance company to sell the social media app by January 19. This law requires that if ByteDance does not sell the short video app until January 19, the company will have to face a TikTok ban in the U.S.
It’s important to mention that these two companies tried to warn that if the court action is not accepted, U.S. law would require the U.S. to ban TikTok, a social media platform that has more than 170 million U.S. active monthly users.
However, even for these reasons, the court decided to reject the appeal, according to the U.S Court, the two companies, TikTok and ByteDance didn’t specify a past case "in which a court, after rejecting a constitutional challenge to an Act of Congress, has enjoined the Act from going into effect while review is sought in the Supreme Court,".
So, according to U.S. law, the social media app will get a TikTok ban in U.S. territory only if the parent company ByteDance will not be able to sell it until January 19. It should be mentioned that the U.S. law also gives the government the authority to ban other foreign-owned apps that may pose problems with the data collection.
The U.S. Justice Department's argument is all about that the "continued Chinese control of the TikTok application poses a continuing threat to national security.".
The short video app claims that the Justice Department managed to misrepresent the relationship with China. In response to that, TikTok stated that the content recommendation engine along with the user data is stored in the U.S. territory, in the Oracle’s cloud servers. Also, content moderation verdicts that could have an impact on U.S. users are made in the country.
It remains to be seen whether the parent company ByteDance will face a TikTok ban, or if the Supreme Court will reverse the government decision.
