and develop their artificial intelligence models based on different X data.
It should be mentioned that Elon Musk, the owner of X, AI trained its Grok AI chatbot on various X user information and data, which led to an investigation by the EU privacy regulator. This investigation was about the fact that the company had not changed yet the privacy policy to clarify that users' data and information can be used by third-party collaborators.
This privacy policy addition to Elon Musk X's social platform suggests that along with the social media platform, others like Reddit and media organizations are exploring the possibility of licensing data to companies powered by artificial intelligence as a new source of revenue.
So, in Section 3 of the Privacy policy which is about “Sharing information”, the social media platform introduced a new paragraph about how various users’ data and information can be used and how users have the possibility to back out from it.
“Third-party collaborators. Depending on your settings, or if you decide to share your data, we may share or disclose your information with third parties. If you opt-outopt out, in some instances the recipients of the information may use it for own independent purposes in addition to those stated in X’s Privacy Policy, including, for example, to train their artificial intelligence models, whether generative or otherwise.”, included in Section 3.
Even though the X update in the privacy policy explains where users should go to toggle the data-sharing, in the actual app setting there is not yet such a button. Currently, users can toggle off just the xAI’s Grok data sharing. We tend to believe that, this button will be available in the app’s settings after the privacy policy becomes effective on November 15.
In the Elon Musk X update, the company also decided to remove a paragraph that stated that would keep the personal information and content of users during the availability of the account and also would keep other personal data collected when users are using its products and services for almost 18 months.
Instead of these policies, X added a new section that states that they will hold “different types of information for different periods of time, depending on how long we need to retain it in order to provide you with our products and services, to comply with our legal requirements and for safety and security reasons.”
Individually, in another X update the company has introduced a “Liquidated Damages” clause in their revised Terms of Service which states that any organization that scrapes its content will be held responsible for damages. So, X social platforms mentioned that the organization will be charged $15,000 per 1,000,000 posts “for requesting, viewing, or accessing more than 1,000,000 posts (including reply posts, video posts, image posts, and any other posts) in any 24-hour period,”.
